General terms and conditions of the company Kazai Studios GmbH

1. Scope and definitions

1.1 These terms and conditions apply to all business relations between us, the "Seller" and the "Customer" in the version valid at the time of the order.

1.2 Our online store is aimed exclusively at consumers. "Customers" in the sense of these General Terms and Conditions are therefore only consumers.

1.3 "Customer" in the sense of these General Terms and Conditions is any natural person who maintains business relations with us for a purpose that can be attributed neither to his commercial nor to his independent professional activity (§ 13 BGB).

1.4 "Seller" within the meaning of these General Terms and Conditions are all natural or legal persons with legal capacity who enter into business relations with customers and business partners

2. Conclusion of contract

The following regulations about the conclusion of the contract are valid for orders in our internet store www.kazaistudios.com.

2.1 If a contract is concluded, it is concluded between the customer and the following company.

2.2 The placement of goods in our Internet store does not constitute a legally binding contract offer by us, but is merely a non-binding invitation to the customer to order these goods. If the customer orders the desired goods, he thereby submits an offer to conclude a purchase contract that is binding for him for a period of 2 weeks.

2.3 The Customer may submit the offer via the online order form integrated into the Seller's online store. In doing so, after having placed the selected goods in the virtual shopping cart and having checked and gone through the electronic ordering process, the Customer submits a legally binding contractual offer with regard to the products contained in the shopping cart by pressing the "Buy" button.

2.4 After receipt of the order, we will confirm it by sending an automatically written "Order Confirmation" as an e-mail. However, this e-mail does not constitute an acceptance of the offer on our part. An acceptance of the offer by us shall be made in writing, in text form or by sending the goods.

2.5 The period for the acceptance of the offer begins on the day after the sending of the offer by the customer and ends with the expiry of the fourteenth day following the sending of the offer.

2.6 We reserve the right to check the offer of a customer and not to accept every offer. For example, we reserve the right to reject a customer's offer if we have indications or reason to suspect that technical aids (e.g. bots) were used in the submission of the offer. In the event of non-acceptance of an offer, we do not owe a separate explanation or reason for the rejection. If the Seller does not accept the Customer's offer within the aforementioned period, this shall be deemed to be a rejection of the offer with the consequence that the Customer shall no longer be bound by its declaration of intent.

2.7 If the customer selects "PayPal Express" as a payment method during the online ordering process, he also issues a payment order to his payment service provider by clicking the button that concludes the ordering process. In this case, the seller declares, in deviation from section 2.6, the acceptance of the customer's offer at the time when the customer triggers the payment process by clicking the button that concludes the order process.

2.8 The Seller sends the data of the order to the Customer by e-mail. The General Terms and Conditions are available at www.kazaistudios.com/pages/agb. In addition, the text of the contract is archived on the Seller's website and can be accessed free of charge by the Customer via his password-protected customer account by providing the relevant login data, provided that the Customer has created a customer account in the Seller's online store before submitting his order.

2.9 Order processing and contacting usually take place via e-mail and automated order processing. The customer must ensure that the e-mail address provided by him for order processing is correct so that e-mails sent by the seller can be received at this address. In particular, when using SPAM filters, the customer must ensure that all e-mails sent by the seller or by third parties commissioned by the seller to process the order can be delivered.

3. Prices and Terms of Payment & Shipping and Delivery Conditions


3.1 All prices that we indicate in our online store include the statutory sales tax and other price components. Not included are any shipping costs, which may be charged separately.

3.2 Payment is made by PayPal, credit card (Mastercard, Maestro, Visa, Amex), Sofortüberweisung(Klarna) or wallet payment (ApplePay, GooglePay, Shop Pay, Amazon Pay). We reserve the right not to offer all payment methods for certain order/delivery requests as well as to require payment in advance for the order placed in order to secure the credit risk according to the creditworthiness of the customer.

3.3 Depending on the payment method chosen by the customer, payment and debiting of the customer's account shall be made in accordance with the regulations agreed with the respective payment provider (including their GTC).

3.4 In the case of deliveries to countries outside the European Union, further costs may be incurred in individual cases for which the Seller is not responsible and which are to be borne by the Customer. These include, for example, costs for the transfer of money by credit institutions (e.g. transfer fees, exchange rate fees) or import duties or taxes (e.g. customs duties).

3.5 The delivery of goods is carried out by shipping to the delivery address specified by the customer, unless otherwise agreed. When processing the transaction, the delivery address specified in the Seller's order processing shall be decisive.

3.6 If a shipment cannot be delivered due to incorrect information on the part of the customer or if the customer refuses to accept the delivery, the customer shall bear the incurred return costs. We reserve the right to retain these costs in the event of a refund.

3.7 The customer will not receive an invoice with the delivery of the goods. If the receipt of an invoice is desired, the customer can request it from the seller.

4. Right of withdrawal


Consumers are generally entitled to a right of withdrawal. More information on the right of withdrawal can be found in the cancellation policy of the seller.

5. Ownership

We retain ownership of the goods until full payment of the purchase price.

6. Returns


6.1 The Seller guarantees a full refund, excluding shipping costs, provided that all items have been returned in the condition they were in when received. This means the items must not be damaged, soiled, washed, altered or worn (except for fitting). In addition, all tags and labels must be intact.

6.2 Since underwear and swimwear are hygiene items, they are excluded from exchange.

6.3 If the goods are nevertheless returned, the seller will send the goods back to the customer and charge this shipping. The purchase amount will not be refunded in this case.

7. Warranty


7.1 For consumers, the statutory warranty provisions apply.

7.2 By concluding the contract, the consumer declares that he/she will care for the goods according to the instructions in the textile label. If a garment is damaged by the consumer due to failure to follow the instructions in the textile label, the claim to the statutory warranty shall lapse.

7.3 In case of a complaint after the expiry of the withdrawal period, the consumer must prove that damage was present from the beginning.

8. Applicable law


8.1 Only the German language shall be applicable for the performance and execution of the contract.

8.2 The contractual relations shall be governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers who do not conclude the contract for professional or commercial purposes, the above choice of law shall only apply insofar as the protection granted is not withdrawn by mandatory provisions of the law of the country in which the consumer has his habitual residence.

The customer will receive a cap of his choice worth € 44.00 as an extra for each purchase above an order value of € 50.00.

In the event of a return of the entire purchase, in which the customer keeps the free gift, the claim to the free gift is forfeited. Kazai Studios GmbH will refund the purchase amount minus the value of the cap.

The special promotion is a limited time promotion by Kazai Studios GmbH. The contracting party has no legal claim to a discount or encore.

If the desired item is sold out, the customer has no right to the item of choice.

Additional terms and conditions of the special promotion "GIFTCARD25" from 15.12.2020 to 22.01.2021:

The customer can receive a "GIFTCARD25" voucher code as a free addition to any purchase if he/she adds another product to the shopping cart and wishes to purchase it. For this, the "GIFTCARD25" must be placed in the shopping cart so that the action can be applied automatically. This product is a digital product which will be sent by email after the order. With this coupon code the customer has a credit of 25€ in the store.

In the event of a return of the purchase, the claim to the free addition is forfeited and the voucher code is cancelled. If the voucher code has already been redeemed at the time of return, we will refund the purchase price of the order and retain the value of the voucher. The special promotion is a limited time promotion of Kazai Studios GmbH. The contractual partner has no legal claim to a cash payment, discount or bonus.

Additional terms and conditions of the special promotion "BLACKOUTFIT" from 22.01.2021 to 08.02.2021:


The customer will receive one of the hats "Lux Chunky Beanie" in black/gold or "Manhattan Chunky Beanie" in black/gold worth €44.00 as an encore when purchasing the item "Dynasty Wool Coat" in the color black.

In case of a return of the "Dynasty Wool Coat", where the customer keeps the free gift, the claim to the free gift expires. Kazai Studios GmbH will refund the purchase amount minus the value of the hat.

The special promotion is a limited time promotion by Kazai Studios GmbH. The contracting party has no legal claim to a discount or encore.

If the desired item is sold out, the customer has no right to the item of choice.

Additional terms and conditions of the special promotion "WINTER21" from 11.02.2021 to 11.03.2021:

The customer will receive a cap of his choice worth € 44.00 as an encore for every purchase above an order value of € 50.00.

In the event of a return of the entire purchase, in which the customer keeps the free gift, the claim to the free gift is forfeited. Kazai Studios GmbH will refund the purchase amount minus the value of the cap.

The special promotion is a limited time promotion by Kazai Studios GmbH. The contracting party has no legal claim to a discount or encore.
